UBC Properties Investments, City of Kelowna facing class action lawsuit over downtown campus construction

A class-action lawsuit has been filed against UBC Properties Investments and the City of Kelowna over the construction of the downtown campus, according to recent reports.

The lawsuit, filed by a group of residents and business owners in the area, alleges that the construction of the UBC Okanagan campus in downtown Kelowna has caused significant disruptions and damages to the community.

The plaintiffs claim that the construction has resulted in excessive noise, dust, and traffic, making it difficult for residents and businesses to operate normally. They also allege that the construction has caused damage to nearby buildings and infrastructure.

The lawsuit further states that the defendants, UBC Properties Investments and the City of Kelowna, failed to properly consult with the community and obtain necessary permits before beginning construction.

In response to the lawsuit, UBC Properties Investments has stated that they have followed all necessary procedures and have worked closely with the City of Kelowna to ensure the project is carried out in compliance with regulations.

The City of Kelowna has also released a statement, acknowledging the lawsuit and stating that they will be reviewing the claims and responding accordingly.

This is not the first time that the UBC Okanagan campus construction has faced backlash from the community. In 2019, a group of residents and business owners filed a petition against the project, citing similar concerns about noise and disruption.

The class-action lawsuit is seeking compensation for damages and a halt to the construction until proper measures are taken to address the community’s concerns.

The case is currently ongoing and both parties are expected to present their arguments in court. We will continue to monitor the developments of this case and provide updates as they become available.
