A teenage girl has pleaded guilty to assault in connection with the death of a homeless man in Toronto.
The 17-year-old, who cannot be named due to her age, appeared in court on Monday and admitted to assaulting 64-year-old John Doe on May 10, 2021. Doe was found unconscious and with serious injuries in a downtown Toronto park and later died in hospital.
The girl, who was 16 at the time of the incident, was initially charged with second-degree murder. However, the charge was reduced to assault causing bodily harm after the Crown determined there was not enough evidence to prove intent to kill.
According to the agreed statement of facts, the girl and two other individuals were walking through the park when they came across Doe, who was sleeping on a bench. The girl proceeded to kick and punch Doe multiple times, while the other two individuals watched.
Doe was found by a passerby the next morning and was taken to hospital, where he succumbed to his injuries. The cause of death was determined to be blunt force trauma to the head.
The girl’s lawyer, John Smith, stated that his client has expressed remorse for her actions and has taken responsibility for her role in Doe’s death. He also mentioned that the girl has a history of mental health issues and was under the influence of drugs at the time of the incident.
The Crown is seeking a sentence of two years in a youth detention center, followed by three years of probation. The girl’s sentencing hearing is scheduled for October 15.
