B.C. municipality takes couple to court over under-construction 'eyesore'

A British Columbia municipality has taken legal action against a couple for an ongoing construction project that has been deemed an eyesore by the community.

The District of North Vancouver filed a petition in the Supreme Court of British Columbia on Monday, seeking an order to force the couple to complete the construction of their home, which has been left unfinished for over a year.

According to the petition, the couple began construction on their home in 2019 but have since failed to complete the project, leaving the property in a state of disarray. The municipality claims that the unfinished home is not only an eyesore but also poses a safety hazard to the surrounding area.

The petition also states that the couple has ignored multiple notices and orders from the municipality to complete the construction and bring the property up to code. The municipality is seeking an order for the couple to complete the construction within a specified timeline and to comply with all building and safety regulations.

The District of North Vancouver Mayor, Mike Little, expressed his disappointment with the situation, stating that the municipality has been working with the couple for over a year to resolve the issue but has been met with resistance.

“We understand that construction projects can face challenges, but it is the responsibility of the property owners to ensure that their project is completed in a timely and safe manner,” said Mayor Little.

The couple has yet to respond to the petition, and a court date has not yet been set.

This is not the first time that the District of North Vancouver has taken legal action against property owners for unfinished construction projects. In 2018, the municipality successfully obtained a court order to force a homeowner to complete their construction project after it had been left unfinished for over two years.

The District of North Vancouver is urging property owners to take their responsibilities seriously and to ensure that their construction projects are completed in a timely and safe manner to avoid legal action.

The case will now proceed to court, where a judge will make a decision on the matter. The municipality hopes that this legal action will serve as a reminder to property owners to fulfill their obligations and maintain the integrity of their community.
